Terms of Service

These Terms of Service (the Terms) govern your access to and use of UploadHub, a media hosting and content delivery service available at uploadhub.gg (the Service). The Service is operated by DEVHUB SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (DEVHUB sp. z o.o.), with its registered office at ul. Prezydenta Gabriela Narutowicza 40/1, 90-135 Łódź, Poland, registered in the Polish National Court Register under KRS number 0001165543, NIP 7252354126, REGON 541337284 (we, us, or the Company).
By creating an account, uploading content, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who may use the Service
You may use the Service only if you are at least 16 years old and able to enter into a binding contract. If you use the Service on behalf of an organisation or a game server, you represent that you are authorised to accept these Terms on its behalf, and references to you include that organisation.
Accounts are created by signing in with Discord. You are responsible for all activity under your account and for keeping your Discord account and any API keys or webhook URLs secure. You must comply with Discord's own terms when signing in.
2. The Service and projects
The Service lets you upload images, GIFs, video, and audio, and serve them from a content delivery network. Content, team members, plan, usage, and billing are organised into projects. We may add, change, or remove features at any time. We may also impose or change usage limits (for example storage, bandwidth, request, file-size, and project limits) as described on the pricing page or in the dashboard.
3. Plans, billing, and payments
A free plan is available. Paid plans are sold by DEVHUB sp. z o.o. as recurring subscriptions and are processed by our payment processor, Stripe (Stripe Payments Europe, Ltd.), subject to Stripe's own terms. Prices are shown before purchase and may include or exclude applicable taxes as indicated at checkout.
Paid plans may renew automatically for successive billing periods until cancelled. You may cancel a subscription at any time; cancellation stops future renewals and takes effect at the end of the current billing period. We do not provide pro-rated refunds for partial periods except where required by law or under Section 4.
4. Right of withdrawal (consumers in the EU)
If you are a consumer within the European Union, you have the right to withdraw from a paid plan within 14 days of purchase without giving a reason. However, because the Service is digital content and an online service supplied immediately, you acknowledge and agree that where you request that we begin performance during the 14-day period and confirm that you understand you thereby lose your right of withdrawal, that right expires once the Service has been fully performed. To exercise a valid right of withdrawal, contact us at support@uploadhub.gg. Statutory consumer rights under Polish and EU law are not affected by these Terms.
5. Your content
You retain all ownership rights in the content you upload (Your Content). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, cache, reproduce, adapt (for example converting images to WebP and generating thumbnails), transmit, and display Your Content solely to the extent necessary to operate, secure, and provide the Service to you and your end users. This licence ends when Your Content is deleted, except for copies retained transiently in caches or backups for a limited period, or as required by law.
You represent and warrant that:
- you own Your Content or have all rights and permissions needed to upload it and grant the licence above;
- Your Content and its use through the Service do not infringe any third party's rights or violate any law; and
- Your Content complies with our Acceptable Use Policy.
You are solely responsible for Your Content, including content submitted through your API keys, webhooks, or by players on your game server.
6. Acceptable use
Your use of the Service must comply with our Acceptable Use Policy, which is incorporated into these Terms by reference. Prohibited content and conduct described there may result in removal of content, suspension, or termination.
7. Content scanning and moderation
To keep the Service safe and lawful, uploaded files are placed in a private quarantine area and automatically scanned before they are published. Scanning may include malware detection and hash-matching against known child sexual abuse material (CSAM). We may remove, disable, or refuse to serve any content, and we may report unlawful content, in particular suspected CSAM, to the relevant authorities and organisations as required or permitted by law. We do not routinely review your content manually, but we may do so in response to reports or legal obligations.
8. Availability and fair use
We aim to keep the Service available and reliable, but we provide it on an as available basis and do not guarantee uninterrupted or error-free operation. We may perform maintenance, and we may throttle, suspend, or limit usage that materially exceeds your plan, threatens the stability or security of the Service, or is abusive.
9. Our intellectual property
The Service, including its software, design, trademarks, and documentation, is owned by us or our licensors and is protected by law. Except for the rights expressly granted to you, we reserve all rights. The downloadable FiveM resource is provided for use with the Service under the licence stated in its files.
10. Suspension and termination
You may stop using the Service and delete your projects at any time. We may suspend or terminate your access, remove content, or close your account if you breach these Terms or the Acceptable Use Policy, if required by law, or to protect the Service or others. Where reasonable and lawful we will give you notice. On termination, your right to use the Service ends and we may delete Your Content and account data, subject to any legal retention obligations.
11. Disclaimers
To the fullest extent permitted by law, and without limiting your statutory rights as a consumer, the Service is provided without warranties of any kind, whether express or implied, including fitness for a particular purpose, availability, or that content will not be lost. You are responsible for keeping your own copies of Your Content.
12. Limitation of liability
Nothing in these Terms excludes or limits our liability where it cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for intentional damage, or under mandatory consumer-protection provisions of Polish law. Subject to that, and to the fullest extent permitted by law, we are not liable for indirect or consequential loss, loss of data, loss of profits, or loss of goodwill; and our total aggregate liability arising out of or relating to the Service is limited to the greater of the amounts you paid to us for the Service in the 12 months before the event giving rise to the liability, or 100 EUR.
13. Indemnity
If you use the Service other than as a consumer, you agree to indemnify us against claims, losses, and reasonable costs arising from Your Content or your breach of these Terms or the Acceptable Use Policy, to the extent permitted by law.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, for example by a notice in the dashboard or by email. Changes take effect on the date stated. If you do not accept the changes, you should stop using the Service; continued use after the effective date means you accept the updated Terms.
15. Governing law and disputes
These Terms are governed by the law of the Republic of Poland. If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts having jurisdiction under applicable consumer-protection rules. Consumers may also use the European Commission's online dispute resolution platform at https://ec.europa.eu/consumers/odr and the Polish Office of Competition and Consumer Protection (UOKiK). For other users, disputes are subject to the exclusive jurisdiction of the Polish courts competent for our registered office.
